Terms & Conditions

Identification

For the purpose of this document, the document will be referred to as a confirmation from this point forward. The guest, renter or tenant is referred to as guest from this point forward. Vacation home or condominium shall be referred to as rental property from this point forward. The homeowner will be referred to as property owner from this point forward.

Age Restriction

All Island Dreams Realty vacation rental properties require a minimum booking age of 25 years. The legal renter named on the rental agreement must occupy the property during the dates listed on the rental agreement and identification must be furnished upon request.

Payment Terms

Reservations will require an initial payment of 30%. Final payments are due the very latest 30 days prior to arrival. Any final payment that is not received by the due date may result in cancellation of the reservation. Administrative fees must be paid by guest. For bookings with origination from an online travel agency such as, but not limited to, Homeaway/ VRBO, guest authorizes Island Dreams Realty to charge credit card on file on the due date. Guest is required to inform Island Dreams Realty at least 48 hours before due date of different payment arrangements, which has to be confirmed in writing by Island Dreams Realty.

Check-In

The check-in process begins at 4 p.m., but cannot be guaranteed. In some cases check-in may be delayed due to circumstances beyond our control. Rate adjustments cannot be made for late check-in or early departure. Early check-ins without prior permission from Island Dreams will and cannot be accommodated.

Cancellation Policy

Cancellation more than 150 days prior to arrival will receive a deposit refund less a $200 cancellation fee. Cancellation less than 150 days prior to arrival will forfeit the deposit. Cancellation less than 30 days prior to arrival will forfeit all monies on account. Cancellations must be confirmed in writing. No refund for weather, medical reasons or acts of nature such as but not limited to hurricanes, tropical storms, red tide & pandemics. We encourage all guests to research and purchase travel insurance accordingly.

If Island Dreams is able to rebook the property at no loss of income to homeowner, a respective refund minus a 5% fee will be issued.

COVID-19

If your stay is subject to a local vacation rental suspension and arrival date is within 45 days, a full refund minus a 5% fee can be offered, or credit for a future stay within 12 months.

Island Dreams unfortunately cannot offer refunds or rescheduling of stays that are subject to travel restrictions, advisories, health concerns and alike, unless the property is rebooked at no loss of income to homeowner.

Confirmation

Reservations are not considered confirmed until a member of Island Dreams Realty management has approved the booking. Island Dreams Realty reserves the right to audit, adjust, or cancel any confirmed reservation for inaccuracy or misquoted information at no penalty to Island Dreams Realty. Confirmation of rental property can only be established when a deposit is made. All payment and cancellation policies are placed in effect at that time. Once a reservation is confirmed, the rental property will be assigned.

Substitution of Accommodations

Island Dreams Realty reserves the right to move, relocate, reassign or change the rental property noted on the front of this confirmation for reason of emergency that include but are not limited to instances such as broken air conditioning, flooding, plumbing etc.. Island Dreams Realty will make every effort to rebook the guest in a like and kind or upgraded rental property. Furthermore, under no circumstances does this confirmation guarantee the rental property selection or assignment if rental property had a change in ownership. Such reservations are usually honored by new rental property ownership, but can never be guaranteed by Island Dreams Realty.

Maximum Occupants

The maximum number of guests is set by the property owner and/or association and includes small children and infants. The maximum occupancy for your rental property is noted on the confirmation. Exceeding these limits shall result in forfeiture of payments/deposits and can at the sole discretion of Island Dreams Realty incur an extra charge per person to the guest. Reservations obtained under false pretenses will, under Island Dreams Realty sole discretion, cause forfeiture of all payments and the guests will be asked to vacate the rental property immediately.

House Parties

Island Dreams Realty does not allow house parties in any rental property. Guests are not allowed to organize graduations, proms, gatherings, reunions, weddings, receptions or any other function similar in nature. Only the guests listed in the reservation are permitted on the property, including in the pool (if applicable) and grounds.

Association Rules

All accommodations are confirmed with the understanding that all guests will abide by the rules and regulations prescribed by individual owners, condominium or homeowner associations as required for each rental property.

No Smoking

All Island Dreams Realty rental properties are considered non-smoking. Smoking is permitted outside only. Any guest that smokes inside a rental property will be asked to leave immediately and all charges to restore the rental property back to its original condition will be charged to the guest.

No Weapons or Fireworks Allowed

Weapons and fireworks are not allowed on the premise of Island Dreams Realty rental properties.

Acts of Nature

Island Dreams Realty cannot be held liable for any acts of nature or occurrences beyond our control, including but not limited to tropical storms, hurricanes or red tide. No rate adjustments will be made.

Quiet Use & Employment

Island Dreams Realty does not guarantee quiet use or enjoyment of rental properties due to noise from other persons, neighboring properties, construction, maintenance, etc. Island Dreams Realty cannot grant rate adjustments resulting from circumstances outside of the rental property. Island Dreams Realty expects guest to respect the local ordinances as well as keep a respectful volume after 10 PM.

Noise Ordinance

A strict 10PM noise ordinance is enforced by the City and Island Dreams Realty. The goal of the local noise ordinance is not to limit the enjoyment of your vacationing experience, instead is designed to ensure a quality stay for every guest as well as resident. Please me mindful of our neighbors during your stay. Exceeding the noise ordinance could result in a warning from local law enforcement, code enforcement, or Island Dreams, and continuing to ignore the ordinance after warning could result in further disciplinary actions including fines and vacating the property without any refund.

Pets

Pets are not permitted in most rental properties unless specifically authorized. In the event that a rental property does accept a pet, Island Dreams Realty must be notified when making the reservation and a non-refundable pet fee is applied to the reservation. In the event that a guest has a pet in a rental property without prior authorization will result in forfeiture of all payments, the guests will be asked to remove the animal and/or vacate the rental property immediately. The guest will be charged for any costs with regard to returning the rental property to its original condition.

Furnishings

All rental properties are individually owned and decorated. Items such as furnishings, appliances, equipment, style, quality, colors, etc. are provided solely by the owner. Island Dreams Realty does not accept liability for the aesthetic or functional perception of the rental properties contents and no rate adjustment can be made.

Amenities

Amenities vary at each rental property. Please contact Island Dreams Realty for specific needs you may have regarding rental property amenities. Island Dreams Realty is not liable for malfunction or closure of rental property amenities. Amenities are subject to change without prior notice and no credits, refunds and/or discounts will be issued.

Units for Sale

In the event that the rental property, which a guest is renting, is listed for sale, we may find the need to show the property during a guest’s stay. We will make every attempt to schedule the showing at a convenient time so as not to disturb your vacation. By acceptance of this confirmation guest agrees to allow showings of rental property.

Entry of Premises

Guest agrees to allow Island Dreams Realty employees, vendors, contractors or subcontractors access to the rental property for any reason such as but not limited to repairs, improvements, care for or manage the property. We will make every effort to properly notify guest.

Agency Disclosure

Island Dreams Realty serves as agent and representative of all owners of condominium units and private dwellings in its rental program and is acting at all times in and for the best interest of the owner.

Pest Control

Rental properties are treated for pest control by a contracted pest control company. Island Dreams Realty will make every effort to address pest control concerns, but is not responsible for rebates due to the presence of pests or in the event of untimely service by pest control companies. Anna Maria Island / Bradenton is a tropical climate and some pests are inherent to the region and climate making them resilient against professional treatment.

Hurricane Policy

If you are travelling between June and November, please note that this is hurricane season. Island Dreams Realty and Owners are not required to rebate rent in the event of a voluntary or mandatory evacuation.

Student Groups

Any guest under 21 years of age must be accompanied by a parent and/or guardian. Reservations obtained under false pretenses will cause forfeiture of all payments and guests will be asked to vacate the rental property immediately.

Accuracy of Information

To the best of Island Dreams Realty knowledge the information contained on this confirmation and our websites is accurate but not guaranteed. Descriptions, rates and property amenities listed on this confirmation are subject to change without notice. Omissions, additions or errors as well as changes in property bedding, furnishings, equipment, etc., shall not be the responsibility of Island Dreams Realty, owner, or agent. Guests are required to check with Island Dreams Realty about specific items of importance to them.

Maid Service & Special Requests

Linens and bath towels are included in each rental property and have been inventoried prior to your arrival. We cannot guarantee your rental property will supply beach equipment. Your rental property is cleaned prior to your arrival and upon your departure, but does not include daily maid service.

Telephone Charges

There is no charge for local telephone calls. Long distance calling within the USA and Canada is also included. For any other international calls we require that you purchase a calling card at a gas station or convenience store. Another suggestion is to utilize a voice-over-IP (VoiP) service such as Skype while using the homes free wifi internet.

Hold Harmless & Indemnity

Guest holds harmless and indemnifies Island Dreams Realty from and against any and all liability, loss, damage, and expense, including reasonable attorney fees and disbursements arising from injury to persons or damage to rental property; occasioned by the failure of the property owner to comply with any provision of law or this agreement; occasioned by any act or omission of the property owner or any person residing in or renting owner’s property; occasioned by any act of omission of the property owner, or property owner’s agents, servants, or contractors; or, occasioned by any act of omission, with the exception of such acts or commissions constituting gross negligence or willful misconduct of Island Dreams Realty and its agents, servants, or contractors when acting as agent for the property owner as provided herein. Special risks may be involved when using pools and/or hot tubs and guest assumes all responsibility for himself/herself and their guests and for the consequences of those at risk. Guest agrees to waive any claim whatsoever and hold harmless Island Dreams Realty and the property owner for accidents and claims resulting from accidents and or injury arising from use of the rental property and any of its equipment, porches, decks, stairs, parking area, elevators etc.

Vehicles

Recreational vehicles (RV’s), boats, motor homes, trucks, trailers etc. are not permitted. Please contact Island Dreams about parking spaces allotted at each unit. Parking on the street is not permitted.

Pools & Spas

Pool equipment is set to run during the day and pool heaters are set to 84 degrees Fahrenheit. Homes that have the capability of higher water temperature require an additional fee per week. Please contact Island Dreams Realty to add this optional amenity to your rental contract. Island Dreams Realty is not responsible for pool or spa malfunctions, but we will make every effort to ensure the owners’ pools are maintained and working properly. No credit, discount and/or rate adjustment can be granted for items mentioned above or circumstances beyond our control.

There will be days when the weather conditions will not allow pool heaters to accommodate swimming, and temperature recovery times will vary. During the winter months pool temperatures are likely to remain around 75 degrees. If several cold days occur, water temperatures will drop and may stay cooler longer. Pool heaters cannot operate and will automatically shut down if outside temperatures fall below 60 degrees. While we take every precaution to ensure that pools are heated as specified, weather conditions may affect the temperature of the pool and spa. Outdoor spas are not hot tubs. Unlike hot tubs that can be heated above 100 degrees water temperatures, spa temperatures are set at the same temperature as the pool.

Because there are no lifeguards or other attendants at the swimming pools, guests are expressly responsible for the safety of themselves, members of their families, and guests using swimming facilities or other recreational facilities, and in so using or permitting to be used, specifically waive any and all liability claims, expressed or implied, against the Property Manager, Condominium Association or Homeowner. No guest shall permit any juvenile or non-swimming member of his family or guest to play in or around any swimming facility or accessible boat canal without providing an attendant who is able to swim and can protect such juvenile in case of difficulty in the water.
Private homes with pools have weekly maintenance carried out by a qualified and licensed pool company. Due to the tropical nature of our Island it is not unusual to find unexpected debris in the pool falling from trees & surrounding vegetation, especially when there is a breeze or rain showers. If you wish to arrange for additional pool service, this can be scheduled with the pool company for a $40 cash payment due from guest at time additional pool service is completed. Island Dreams Realty is not responsible for pool/spa closures or malfunctions. No credit, discount and/or rate adjustments can be granted for circumstances beyond our control.

Radon Gas

Radon Gas is a naturally occurring radioactive gas that, when accumulated in a building in sufficient quantities may present health risks to persons who are exposed to it over time. Levels that exceed Federal and State guidelines have been found in buildings in Florida.
